Construction Dispute Boards and Arbitration
Many contracts governing large construction projects include a dispute resolution provision which will outline the dispute resolution process. Oftentimes, especially in the case of large construction projects that will span several years, these provisions provide for the creation of dispute boards.
Dispute boards are composed of independent and impartial parties selected by the parties at the beginning of the project before any disputes occur, who are actively involved in the construction project throughout. Although their determinations are not binding, their advice is respected because they have been involved from the beginning. This process allows the project to continue without costly interruptions and delays.
Where a construction project's contract does not provide for dispute boards or where one or more of the involved parties does not agree with the board's findings, the dispute will often go to litigation or possibly to arbitration, where the governing contract so provides.
